Rule 9.1 Applicable Provisions

When someone is sentenced to death, their case goes through a special appeals process. The rules found in sections 9.1 through 9.6 spell out exactly how these death penalty appeals work, whether the person went to trial or pleaded guilty. These rules apply no matter how the case got to this point.

If these specific death penalty rules don't cover a particular question or situation, the court falls back on the general appeal rules found elsewhere (Sections I through V). So the death penalty rules come first, but they don't cover every possible scenario. When there's a gap, the standard appeal procedures fill it in.

It's also worth knowing that appealing a death sentence is different from filing a post-conviction appeal later on. If someone wants to challenge their conviction or sentence after their direct appeal is finished, that process is covered under Rule 9.7, not these rules.
