§ 1304 Examination of charge.

When a corporation is charged with a crime, it gets a summons instead of an arrest, telling it to appear in court on a certain date. On that date, the judge looks at the charge against the corporation the same way he would look at a charge against a regular person. He follows the normal steps for reviewing evidence and deciding if the case should move forward, just applied to a business instead of an individual.

This means a corporation does not get special treatment just because it is not a person. The judge still checks whether there is enough evidence to support the charge, using the same process used in any other criminal case. Any court procedures that make sense for a corporation will apply, and steps that only make sense for an individual (like decisions about jail or personal appearance) simply will not apply.
