§ 1365 Costs and fees.

If someone wants to appeal their criminal case and they qualify for a public defender because they can't afford a lawyer, they still might have to pay for certain costs of the appeal. This includes things like court transcripts and filing fees needed to move the appeal forward.

The rule says the defendant has to pay these costs themselves if they can actually afford to. The court looks at whether the person has enough money to cover these expenses, even if they qualified for free legal help under the Indigent Defense Act.

If the defendant truly cannot pay these costs, the county steps in to cover them. The money comes from the court fund in the county where the person was convicted. This way, someone who genuinely has no money isn't blocked from appealing their case just because they can't pay for transcripts or fees.
