If a judge cancels or throws out an indictment or a criminal charge under these court rules, that doesn't mean the case is over for good. Prosecutors can still bring the same charge again later.

This rule protects the state's ability to keep pursuing a case even if there was a problem with the paperwork or process the first time. For example, if an indictment gets set aside because of some technical issue or procedural mistake, the person accused of the crime isn't automatically off the hook. The government can start over and try again to formally charge them for the same offense.
