Sec 3.4 Substitute Supervising Attorney

If the regular supervising attorney can’t be there, another attorney can step in and supervise a Licensed Legal Intern instead. This backup attorney has to meet all the same qualifications as a regular supervising attorney, except they don’t have to file the initial paperwork or already be on the approved list.

There are two ways someone can qualify as this backup supervisor. First, they can work at the same law firm as the original supervising attorney. Second, they can be an attorney from a different firm, or even work alone, as long as they share office space with the supervising attorney. In that second situation, though, the original supervising attorney still has to formally join the case as co-counsel any time the intern uses their limited license.

Basically, this rule makes sure a legal intern always has proper supervision, even when their main supervisor is unavailable, while still keeping the original attorney connected to the case in certain setups.
