RULE 1.52 CONTENT OF PETITION FOR CERTIORARI TO REVIEW CERTIFIED INTERLOCUTORY ORDER AND TRIAL COURT STATEMENT

When someone wants to ask the Oklahoma Supreme Court to review a trial court's order before the case is fully finished, they file something called a petition for certiorari. This rule explains what that petition needs to include and how it should be formatted.

The person asking for review is called the "petitioner," and everyone else in the case is called a "respondent." The petition must list the parties in the same order they appeared in the original trial court case. You need to file one original copy plus 14 additional copies, and the petition has to follow a specific form set out in Rule 1.301, Form No. 7.

The petition also needs an attachment from the trial judge. This attachment must briefly explain what the relevant court records will show once they're typed up, and it must explain why the judge thinks the appeals court should review this order right away, instead of waiting until the whole case is over. Without this signed statement from the trial court, the petition is incomplete.
