RULE 1.53 RESPONSE TO PETITION FOR CERTIORARI TO REVIEW INTERLOCUTORY ORDER

If someone files a petition asking the Oklahoma Supreme Court to review a lower court's interlocutory order (a ruling made before the case is fully finished), the other side gets a chance to respond. That response must be filed within 15 days after the petition was filed.

The response needs to follow a specific format, laid out in Rule 1.301, Form No. 8. When filing, the respondent must submit the original response plus 14 copies, for a total of 15 documents given to the court.

This rule matters because it sets a strict deadline. If the respondent misses the 15 day window or fails to include enough copies, they risk losing the chance to have their side heard before the court decides whether to take up the case.
