§ 131.305 Place of trial

A criminal case usually has to be filed and tried in the county where the crime happened. This means if something illegal took place in Multnomah County, the case normally goes to court there, not in a different county. The law looks at where the actual actions occurred, or where the harmful result happened, to decide which county has the right to handle the case.

If a defendant thinks the case was filed in the wrong county, they can't just bring it up whenever they want. They have to raise this objection the right way, following specific steps laid out in other parts of the law (ORS 131.335 to 131.363). If they don't object properly and on time, they lose the chance to challenge it later. In other words, staying quiet about the issue counts as accepting the location, even if it was technically wrong.
