§ 135.680 Procedure if resubmission of case not allowed

If a judge decides that a case cannot go back to the grand jury and no new charges can be filed, the defendant cannot be held any longer. Anyone who was in jail on the case must be let go right away.

If the defendant was already released before this decision, that release agreement ends and the defendant no longer has to follow its conditions. If the defendant paid money as security to get out of jail, that money has to be given back.

In short, this rule protects people from being stuck in the system when a case falls apart. Once the court closes the door on refiling charges, the person gets their freedom back and gets back any money they put up.
