§ 135.770 Release of prisoner prohibited

This rule says that if someone is being held in a county jail because their home state or country wants them sent back for a criminal case, the sheriff cannot let that person go free while the case is being worked out. This applies during the entire process of deciding whether to send the person back, including any appeals that follow.

In simple terms, once someone is arrested and held under this specific extradition process, they stay in custody. There is no option for bail or release while the courts sort out whether the person should be handed over to face charges elsewhere. The person remains in the sheriff's custody from arrest through the final decision, even if they try to appeal that decision.
