§ 153.121 Appeal

If you get a judgment in a violation case, either side (the person charged or the government) can appeal that decision. How you appeal depends on where the case started.

If the case was in justice court or municipal court, you follow the appeal process set out in ORS 138.057, which is the standard process used for violation appeals from those courts.

If the case was in circuit court, you follow the general civil appeal rules found in ORS chapter 19. However, the court will review the case using the same standard it would use for a misdemeanor or felony appeal, not the standard normally used for other civil appeals. This means the court looks at the case a bit more carefully, similar to how it would handle a criminal appeal, even though a violation is not treated as a crime.
