Rule 9.040 Settlement of Personal Injury Claims in Probate Cases

If someone dies or becomes a protected person and their estate has a personal injury claim, the settlement of that claim needs court approval before it's final. To get that approval, the person asking for it must file a petition along with a sworn statement (an affidavit) that explains the details of the settlement. This affidavit needs to include medical records showing what injuries were suffered and what the person's medical outlook is going forward.

Some of these documents may need to stay confidential if the law requires it. The judge reviewing the case can also ask for more information beyond what's submitted if they need it to make a fair decision.

If the settlement involves a "protected person" (someone the court has appointed a guardian or conservator for because they can't manage their own affairs), the probate court must review and approve the deal before it can go through. This step protects people who can't advocate for themselves, making sure any settlement is fair and in their best interest.
