Rule 9.070 Summary Determination of Claim Under ORS 115.145(1)(a) and ORS 115.165

If you're dealing with a claim against an estate and want the court to quickly decide it without a full trial, you need to follow two specific steps. This process is called a "summary determination," and it's allowed under Oregon law when certain claims come up during probate cases.

First, you have to clearly label your request. The heading or caption of your court filing must state that you are asking for a summary determination. This lets the court and other parties know right away what kind of request you're making.

Second, you have to pay the required filing fee when you submit your request. The court won't process your request without this payment. Skipping either of these steps, the labeling or the fee, could cause delays or problems with your request being accepted.
