Rule 1088 Acts of Assembly Not Suspended

These civil procedure rules do not cancel or change two older Pennsylvania laws. Those laws stay in full effect even though the civil procedure rules exist alongside them.

The two laws being protected are from 1925 and 1931. Without seeing the full text of those laws, the key point is that the court rules were written carefully to make sure they did not accidentally overrule or weaken these specific Acts of Assembly.

If one of these older laws applies to your case, you can still rely on it. The civil procedure rules do not take away any rights or procedures those laws created.
