Rule 1091 Conformity to Civil Action

Mandamus is a special type of lawsuit used to force a government official or public body to do something they are legally required to do. Even though it has its own name and purpose, it follows the same basic court procedures as any other civil lawsuit in Pennsylvania.

If there is no special rule in this chapter that covers a specific situation, the regular rules for civil cases apply. This keeps things consistent and means lawyers and parties do not have to learn an entirely different set of procedures just because the case involves mandamus.
