Rule 1310 Discontinuance

To stop an appeal you have already started, you cannot simply walk away from it. You need permission from the court or written agreement from everyone involved in the case.

If all parties agree to drop the appeal, they can sign a written consent form and file it with the court. If everyone does not agree, you must ask the court for permission and make sure all other parties are told about your request.
