Rule 3161.1 Commencement

When you win a court case and need to collect money from the other person, you have to take a formal step to start that process. You do this by filing a specific form called a "praecipe for a writ of execution" with the court clerk (called the prothonotary) in the county where your judgment was recorded.

The form you use must follow the format set out in Rule 3254. The only exception is if your judgment came from a confession of judgment, which has its own separate rules under Rule 2974.1.
