Rule 301 Presumptions

When a law says you can assume something is true based on certain facts, that assumption (called a presumption) still works the same way in court. These rules of evidence do not change how presumptions operate.

For example, if state law says a jury can assume a letter was received if it was properly mailed, that assumption still applies. Courts will continue to follow whatever the law says about presumptions, just as they did before these rules were adopted.
