Rule 807 Residual Exception (Not Adopted)

Pennsylvania has not adopted a residual hearsay exception. This means there is no catch-all rule that allows a judge to admit hearsay statements just because they seem trustworthy or reliable, even if they don't fit into a specific hearsay exception.

If you want to use an out-of-court statement as evidence in a Pennsylvania court, it must fit into one of the specific hearsay exceptions already listed in the rules. Statements that don't qualify under those specific exceptions will generally be kept out of court, no matter how believable they might seem.
