Rule 1335 Withdrawal of Petition

If the county agency decides it no longer wants to move forward with a case against a child or family, the agency's lawyer can drop it. This is called withdrawing the petition.

To make the withdrawal official, the lawyer must file paperwork with the clerk of courts. Simply deciding to drop the case is not enough; the proper forms must be submitted to the court.
