Rule 1336 Re-Filing of the Petition After Withdrawal or Dismissal

If a case gets dropped or thrown out, it can be started again by filing a new petition. This can happen whether the person who filed it chose to drop it themselves or whether a judge dismissed it.

After the case is re-filed, any party involved can ask the judge to dismiss it again. The judge has the power to consider that request and decide whether the case should move forward or be dismissed.
