Rule 270 Additional Testimony

A judge can allow new evidence or testimony to be added to a case at almost any point during the trial, even after both sides have finished presenting their cases. The judge has the power to do this when they believe it will help reach a fair outcome.

There is one key limit to this rule. If a jury is deciding the case, the judge cannot allow new evidence on disputed issues after the jury has already returned its verdict. Once the jury makes its decision, that door is closed.
