Rule 311 On Appeal from Probate Court

When a probate case is appealed and a higher court makes a decision, that decision gets sent back down to the county probate court. The probate court must then follow whatever the higher court decided.

This means the probate court cannot ignore or work around the higher court's ruling. The case returns to the lower court, but that court is bound by what the appeals court said.
