Rule 357 Effect of Dismissal of an Action or Claim

When the business court dismisses your case, you have 60 days to refile that same case in a different court. If you do refile within that window, the clock on your filing deadline (called the statute of limitations) stops running during the time between when your case was dismissed and when you filed it again.

This protection matters because a dismissal can eat up precious time on your deadline to sue. Without this rule, you might lose your right to bring a case simply because the business court dismissed it and you ran out of time to refile. This rule gives you a fair chance to keep your case alive in another court.
