Rule 625 On Money of Deceased

When someone loses a court case and owes money, but then dies before paying, the winner cannot simply send a debt collector or officer to seize property. The normal collection process gets put on hold.

Instead, the person who won the case must file their claim through the deceased person's estate. This means going through the probate process, where the debt gets handled along with other claims against the estate. The winner will get paid if there is enough money in the estate, but they have to follow the proper steps to get in line with other creditors.
