Rule 644 May Give Delivery Bond

When a court officer takes someone's personal property to satisfy a debt, the property does not have to stay with the officer. The defendant can get their property back temporarily by signing a delivery bond.

To get the property back, the defendant must sign a bond that promises to return the property to the officer at a set time and place so it can be sold. The bond must be co-signed by at least two other people who can back it up financially, and the officer must approve them. The bond must also state a fair value for the property.

If the defendant does not bring the property back as promised, they owe that stated fair value to the officer instead. This gives the defendant a chance to keep using their property while the legal process plays out, but still holds them responsible for it.
