Rule 725 Judgment by Default

When you file a lawsuit and the other side does not show up or refuses to respond within the required time, you can win automatically. This is called a default judgment. You do not have to prove your case in a full trial if the other party simply ignores the process.

This rule applies in Justice Court cases in Texas. If you are the person who filed the lawsuit and you show up ready to proceed, but the other party stays silent or refuses to participate, the judge will rule in your favor.
