Rule 762 Writ of Partition

When a court orders property to be divided, the court clerk must prepare an official document called a writ of partition. This document is sent to the local sheriff or constable.

The sheriff or constable then has to personally notify each person appointed as a commissioner that they have been chosen for the job. Along with the writ, the clerk must also include an official copy of the court's order that explains how the property is to be divided.
