Partition cases follow the same basic court rules as any other civil lawsuit in Texas. This covers how you file your paperwork, how the case moves through court, and what evidence you can use.

The only exception is when a rule specific to partition cases applies. In that situation, the partition-specific rule takes over. Think of the general civil rules as the default, and the partition rules as the override when there is a conflict.
