Rule 789 Proof Under Such Plea

When someone pleads "not guilty" in a civil case in Texas, they can use almost any legal defense they have. They do not need to list out every defense ahead of time.

There is one exception. If someone wants to argue that the case was filed too late (called a "limitations" defense), they must specifically state that in their written pleadings. They cannot just bring it up at trial without warning.
