Art. 7.06 AMOUNT OF BAIL

When a judge decides how much bail to set, they have to look at two main things. First, they consider how much money the accused person actually has or can access. Second, they look at how serious the threatened offense is or how serious the crime about to happen would be.

This means bail isn't set using a random number or a fixed amount that applies to everyone. A judge is supposed to think about someone's real financial situation so the bail amount makes sense for that person. At the same time, the judge weighs how dangerous or serious the situation is, since a more serious threat may call for higher bail to make sure the person shows up and follows the rules set by the court.
