Art. 7C.005 OFFENSE

If someone tries to serve or enforce an extreme risk protective order in Texas, that order must have been issued under Texas law. If a person serves or enforces an order (or tries to), and that order came from somewhere other than Texas, they have broken the law.

This means police officers, sheriffs, or anyone else cannot use an out-of-state extreme risk protective order as if it were valid in Texas. Only orders issued through the Texas court system count here.

Breaking this rule is a state jail felony. That means someone convicted of this crime could face jail time and other serious penalties, similar to other state jail felony charges in Texas.
