Rule 15A.21 Service to Parties who are not User of the E-Filing System

If you file something through West Virginia's e-filing system, you need to check whether everyone else involved in the case can actually receive documents that way. Some parties may not use the electronic system. If someone in the case is not signed up for e-filing, you can't just rely on the system to notify them.

When this happens, you have to serve that person the old-fashioned way. This means following the regular rules for delivering court papers, whether that's through the Rules of Civil Procedure or the Family Court rules, depending on the type of case. Basically, mailing, hand delivery, or whatever traditional method applies to your situation.

The point of this rule is to make sure no one gets left out of a case just because they aren't part of the electronic filing system. It puts the responsibility on the person filing the document to check who needs traditional service and to actually follow through on delivering it to them properly.
