Rule 15A.22 Unavailability of E-Filing System

If you try to file something electronically but the E-Filing System is down, you won't automatically be in trouble for missing your deadline. You just need to send in your document as soon as you can, along with a sworn statement explaining that the system was unavailable and that's why you missed the deadline.

There's a time limit on this, though. You must submit the late document and your sworn explanation by 12:00 p.m. (noon) on the next day the circuit clerk's office is open for business after your original deadline passed. So if your filing was due on a Monday and the system was down, you'd need to get everything submitted by noon on Tuesday (assuming the clerk's office is open that day).

This rule gives you a short grace period when technical problems are out of your control, but you still need to act fast and explain what happened. Waiting too long past that noon deadline could mean your filing is still considered late, even if the system outage wasn't your fault.
