Rule 30.02 Scheduling of Hearings

When a court sets a hearing date in a criminal case, it has to make sure any victim gets proper notice first. This means the court can't just pick a random date without thinking about the victim's right to know what's happening in the case.

The court follows two sets of legal requirements when doing this: state law (found in the West Virginia Code) and the state's criminal procedure rules. Both of these spell out what kind of notice victims are entitled to receive and when they need to get it. By following these requirements, the court makes sure victims have a fair chance to stay informed about hearings that relate to their case, and if they want, to attend or participate in them.
