Rule 7025 Substitution of Parties

When someone involved in a court case dies, becomes incompetent, or is transferred out of a case, they may need to be replaced by someone else. This is called substituting a party. The standard federal civil court rules for how to do this (Rule 25 of the Federal Rules of Civil Procedure) apply when this situation comes up in a bankruptcy adversary proceeding.

However, there is one extra rule to follow in bankruptcy cases. Rule 2012 of the bankruptcy rules also applies, which covers what happens when a bankruptcy trustee dies or is replaced during a case. If you are dealing with a change in trustees specifically, you need to follow that rule as well.
