Rule 7028 Persons Before Whom Depositions May Be Taken

Depositions in bankruptcy court adversary proceedings follow the same rules as regular federal civil cases. This means the rules about who can legally conduct a deposition apply here too.

A deposition must be taken before a proper official, such as a notary public or another person authorized by law to administer oaths. The person running the deposition cannot be a relative, employee, or attorney of any party in the case, and cannot have any financial interest in the outcome.
