Rule 10-4 Continuance After Trial Scheduled

Once a trial date is set, the parties cannot simply agree between themselves to postpone it. Only the judge can remove a case from the court's calendar, and the judge can set whatever conditions seem fair.

If someone asks to postpone a trial within five days of the scheduled date, the judge can charge that person up to $50 as a penalty. The only way to avoid this penalty is if there is a specific legal reason or a genuinely good reason for waiting so long to ask for the delay.
