Rule 17-5 Findings and Ruling

When you ask a judge to step down from your case (called a recusal or disqualification motion), a different judge or Supreme Court justice will decide whether that request should be granted. That person can make their decision by reading your written statement alone, or they may hold a hearing to look at more evidence. Either way, they must write down their findings and decision.

If the motion is approved and the original judge is removed, the court will follow its normal process to pick a new judge for your case. One important thing to know: if a judge is found to be disqualified, that finding cannot be used against that judge in any other case or legal proceeding.
