Rule 4-8 Duty to Notify of Previous Presentation to Another Judge

If you or your lawyer have already brought a legal matter to another Georgia court, you cannot bring that same matter to the Business Court without first telling the Business Court about it. You must also share what happened when you brought it to the other court.

This rule keeps judges from being misled. A judge needs to know if another judge already looked at the same issue and what that judge decided. Hiding this information from the Business Court is not allowed.
