§ 24-13-114 [Service of Interstate Discovery Subpoenas]

If you need someone from another state to appear in a Georgia court case or provide evidence, a subpoena can be issued to make that happen. The subpoena comes from the clerk of the superior court and follows the same serving rules as other Georgia subpoenas.

The person must be served the subpoena with enough advance notice before they are required to show up or respond. The law does not set a specific number of days, but the timing must be reasonable so the person has a fair chance to prepare.
