§ 24-8-824 [Voluntariness Requirement for Confession Admissibility]

A confession can only be used against you in court if you gave it freely. That means no one pressured you, threatened you, or promised you anything to get you to confess.

The standard in Georgia is strict. Even a small hint that things might go better for you if you talk, or a vague suggestion that something bad might happen if you don't, can be enough to throw out a confession. The law uses the phrases "slightest hope of benefit" and "remotest fear of injury," which means courts take a hard look at any outside pressure placed on a person before they confessed.

If you were told something like "it'll be easier on you if you just tell us what happened," that kind of statement could make your confession inadmissible. The same goes if you felt scared into talking because of something said or done by police or anyone else involved in the case.
