Rule 26.3 Delayed Indictments

If you are arrested on a felony charge, the prosecutor cannot simply leave you sitting in jail without taking your case to a grand jury. After you have been locked up for 45 days without being formally charged through an indictment, the district attorney must send a written notice to the chief judge within 2 business days.

Once the chief judge receives that notice, they can step in and do whatever they think is fair and needed. This could mean ordering your release, pushing the case forward, or taking other action to address the delay.
