When a criminal case is ready for trial in Superior Court, the judge will set a trial date and put the case on the trial calendar. Both the prosecutor and the defense attorney must be told when the case is scheduled. The court expects everyone to be ready to go on that date.
If a lawyer needs to move a trial date, they must have a good reason and ask the court ahead of time. Judges do not grant delays just because a lawyer asks. The court wants to keep cases moving forward on schedule.
Defendants who are being held in jail while waiting for trial are given priority. This means their cases get scheduled before cases where the defendant is out on bond. The goal is to avoid keeping people locked up longer than necessary while they wait for their day in court.
