§ 60-3325 Time limit for bringing action.

If someone steals your trade secrets or confidential business information in Kansas, you have three years to file a lawsuit about it. The clock starts ticking not from when the theft actually happened, but from when you found out about it or reasonably should have found out about it.

This means if you didn't know your information was stolen right away, you're not automatically out of luck. The court looks at when you discovered the problem, or when you should have discovered it if you had been paying reasonable attention to your business and information.

The rule also says that if someone keeps misusing your stolen information over time, this counts as just one claim, not several separate claims. So you can't restart the three year clock every time the same ongoing misuse happens. You need to act within three years of when you first knew or should have known about the misappropriation, even if it continues afterward.
