Art. 716 Modification of judgment of disposition

If a child has been placed somewhere by court order (like foster care or another placement), that order can be changed later. A judge can update the terms if things have changed enough to justify it.

The rule also says that if the court finds the child can safely go back to living with their parent, the judge must change the order to send the child home. The judge can still set rules and conditions for that return, but the main goal is getting the child back with their parent once it's safe to do so. This gives parents a real path to regain custody when circumstances improve, and it puts the focus on the child's safety and best interests when making that decision.
