Art. 2823 Additional evidence

If someone submits a sworn written statement (an affidavit) as evidence in a case, the judge doesn't have to just take that statement at face value. The judge can ask for more proof to back up what's in the affidavit, just like they would in a regular trial with witnesses and other evidence.

This gives judges flexibility. Even though affidavits are allowed as a quicker way to present facts, the judge can still dig deeper if something needs more support. This helps make sure the facts are solid before the court relies on them to make a decision.

In short, an affidavit alone might not be enough if the judge wants to see additional proof. The other side, or the court itself, can push for more evidence to confirm the facts really are what the affidavit says they are.
