Art. 2824 No affidavit evidence of factual issues

If people in a succession case disagree about the facts, you can't use affidavits (written sworn statements) to prove your side. This applies to any contested issue in the case.

Instead, the facts have to be worked out at trial, just like in a regular civil lawsuit. That means witnesses testify in court, documents get properly introduced as evidence, and both sides can cross-examine and challenge what's presented. This gives everyone a fair chance to question the evidence, rather than letting one side settle a factual dispute just by submitting a signed statement.

In short, if there's a real disagreement about the facts in a succession case, it has to be proven the normal way in court, not through paperwork alone.
