Art. 3828 Custody pendente lite

When a custody case is still being decided and a final decision can't be made right away, the court doesn't have to leave the child without a caregiver in the meantime. Instead, the judge can name someone suitable to take care of the child temporarily, while the case is still going on.

This temporary arrangement lasts only until the court makes its final custody decision. It gives the child a stable place to stay and someone responsible looking after them during the waiting period, instead of leaving things unsettled while the case moves through court.

The person the judge picks doesn't have to be one of the parents fighting for custody. The judge can choose whoever seems like the right fit to care for the child until everything gets sorted out in the final judgment.
