Art. 4394 Service of account

When a tutor (the person who manages a child's money or property) files an account showing how they handled that money, the law requires that a copy be officially delivered to certain people. This is done the same formal way court papers are normally delivered. Along with the account, the person receiving it also gets a notice explaining that the account can be approved by the court (called "homologation") after ten days, and that anyone who disagrees with it must file an objection before that happens.

Who gets this copy depends on the situation. If the account is a yearly or other in-progress report, it goes to the undertutor, who acts as a check on the tutor's work. If the child has grown up and the tutorship has ended, the final account goes to that former child, who is now an adult. If the tutor stopped serving because they resigned, died, were removed, or were declared legally incompetent, the final account goes to whoever took over as the new tutor.

This process gives people time to review how the child's money or property was handled and to raise concerns before the court finalizes everything. It protects the child's interests by making sure someone is watching over the tutor's actions and has a chance to object if something looks wrong.
